BurnerWare is a logistics tool. By using the Platform, you acknowledge that event operations may occur in high-risk environments. These terms contain broad releases of liability and assumption of risk clauses tailored for event coordination.
BurnerWare ("the Platform") provides tools for camp management and logistics. By accessing or using the Platform, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Platform.
NON-AFFILIATION: BurnerWare is an independent software platform. We are NOT affiliated with, endorsed by, or sponsored by the Burning Man Project, Black Rock City LLC, or any other event organization. Any reference to specific events is for descriptive purposes only.
NO CLAIMS OR WARRANTIES: The Platform is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied. We make no claims regarding the accuracy of data, the success of your event operations, or the reliability of the software in remote environments.
ENVIRONMENTAL RISKS: You acknowledge that camp operations often occur in challenging, remote, or extreme environments (including but not limited to the Black Rock Desert). You voluntarily assume all risks related to property damage, personal injury, or death arising from your participation in camp activities managed via this Platform, regardless of the event location.
LIMITATION OF LIABILITY: To the maximum extent permitted by law, BurnerWare and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
You are responsible for the accuracy of the information you provide. While we do not sell your personal data, we may display contextually relevant advertisements to support the operation of the Platform. You retain ownership of your content, but grant us a license to host and display it as necessary to provide the service.
You agree not to use the Platform for any malicious activity, harassment, or to violate any local, state, or federal laws. You are responsible for ensuring your camp's compliance with any specific event rules or principles.
We reserve the right to suspend or terminate your access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the Platform's integrity.
These Terms shall be governed by the laws of the State of Michigan, without regard to its conflict of law provisions. Any legal action or proceeding related to your access to or use of the Platform shall be instituted in a state or federal court in Michigan.
We may modify these Terms at any time. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.
